本演習では、民事訴訟法の基本的な理解を確認しつつ、実務的な観点を踏まえて問題を解決する能力を養うことを目的とする。本学法科大学院でも用いられている教材（三木浩一＝山本和彦編『ロースクール民事訴訟法（第５版）』）の中から重要と思われる問題を取り上げて学習することで、法科大学院での学習の橋渡しとなることを目指す。

This seminar teaches the basics of the Civil Procedural Law especially from practical points of view. The textbook in Tohoku Lawschool is used in this seminar: K.MIKI/K.YAMAMOTO, Law School; Civil Procedural Law.

本演習は，後継者養成コースの院生を対象に，近時の民事手続法における実務的なトピックを考察するものである。民事訴訟法，民事執行法，民事保全法，人事訴訟法，家事事件手続法，非訟事件手続法，倒産法などの領域において実務的に問題となっている応用的・先端的トピックを採り上げる。

私法上の法律関係やこれをめぐる民事裁判手続は、一国（日本）の中で自己完結するとは限らない。現実の裁判においては、例えば、外国に所在する者との間の物品売買契約にはいずれの国又は地域の実体法（日本法とは限らない。）が適用されるのか、このような者に対して日本で訴えを提起できるのか、できるとしてどのような手続が必要になるのか、といった問題が発生する。

そこで、本授業は、①国際的な私法上の法律関係の規律（狭義の国際私法）、②国際的な要素を含む紛争解決手続の規律（国際民事手続法）、③国際的な要素を含む取引の規律（国際取引法）を学ぶことで、上記のような事案を的確に分析できるようになることを目的とする。

This course aims at understanding the fundamental principles of (i) Japanese rules on conflict of laws, (ii) Japanese rules on international civil procedure, (iii) international trade law rules relevant to Japan. The students are expected to learn the practical operation of these rules and to improve the skills on how to properly apply them to cases with international elements.

民事訴訟法上の問題について、すでに一定の程度の学習が進んでいる者を念頭に、報告者が自ら選択したテーマに関する判例や論文の調査・報告と事例問題に関する双方向の議論との双方を通じ、理解を深める。

The purpose of this class is to deepen understanding of the Civil Procedure Law through interactive discussions.

この授業では、行政救済法（行政不服審査法、行政事件訴訟法、国家補償法等）を取り扱います。

This course teaches the Administrative Complaint Review Act, the Administrative Case Litigation Act, and the State Redress Act.

「憲法」判例には「統治機構」判例が含まれ、重要な判例も数多く存在する。本演習では、「統治機構」判例及び関連学説を学習することを通じて、「統治機構」論に関する多くの知見を得ることを目的とする。
