本講義では、民法第4編親族および第5編相続を扱う。

法的制度の定義、要件・効果、制度趣旨といった基本事項を覚えるとともに、それらを用いて教科書に掲載されているような典型的な事例や有名な判例の事例の法的解決を説明できるようになることを目的とする。さらに、判例の読み方をはじめとする法律学の学習方 法についても認識を深めることも目的とする。司法試験受験などに対応するための高度の専門知識や解釈論の対立に立ち入ることは限られてしまうが、そうした学習を志す受講生に向けて、学習を深めるべきポイントの提示などの情報提供は適宜に行う。

This lecture deals with Book 4 (Relatives) and 5 (Inheritance) of the Civil Code. Students learn basic matters such as the definition, requirements / effects, and the purpose of the institutions on civil law, and use them to explain the legal resolution of typical cases.

刑法総論の基本的知識を身につけることを目的とし、基礎理論・構成要件論・違法論・責任論を扱う。

This course aims to provide a basic understanding of the General Theory of criminal law. The following topics are covered; basic theory, actus reus (act, result and causation), mens rea (intent and negligence), justification (self-defense, necessity and consent) and excuse (insanity, duress and mistake of law).

Participants are expected to develop proficiency in legal methodology to recognize patterns in legal issues within the disputed case, apply relevant legal rules to the case, employ sound legal reasoning supported by arguments, resolve the case appropriately, and ultimately produce a legal document based on their legal analysis. Some cases in the course will be drawn from the judicial judgements in foreign countries.

民法の全領域を対象に、判例をベースにした事例問題あるいはオリジナルの事例問題（2023年度の演習からはテーマを変更する）に対する解答を作成し、質疑に応答することを通じて、要件・効果に関する基本的知識とともに解釈論を自ら展開する能力を身につけることを目的とする。

また、毎年新潟大学のゼミとの討論会を実施しており、今年度は12月の土日に新潟大学ゼミを仙台に迎える予定となっている。詳細は、初回授業において説明する。

The purpose of this seminar is to give students the basic knowledge of civil law and to develop the students' abilities to interpret the law through case studies.

A discussion session with seminars from other universities is planed to hold. Details will be explained in the first class.
