本演習では、民事訴訟法の基本的な理解を確認しつつ、実務的な観点を踏まえて問題を解決する能力を養うことを目的とする。本学法科大学院でも用いられている教材（三木浩一＝山本和彦編『ロースクール民事訴訟法（第５版）』）の中から重要と思われる問題を取り上げて学習することで、法科大学院での学習の橋渡しとなることを目指す。

最近の裁判例・論文・立法等を素材としつつ，今日の刑事訴訟法が当面している基本的問題について検討を加えることにより，刑事訴訟法に関する知識・理解を深める。
This course aims (1) to provide a basic understanding of criminal procedure in Japan and (2) to develop problem analysis and proposal abilities for research in this area through discussion of various topics.
私法上の法律関係やこれをめぐる民事裁判手続は、一国（日本）の中で自己完結するとは限らない。現実の裁判においては、例えば、外国に所在する者との間の物品売買契約にはいずれの国又は地域の実体法（日本法とは限らない。）が適用されるのか、このような者に対して日本で訴えを提起できるのか、できるとしてどのような手続が必要になるのか、といった問題が発生する。
そこで、本授業は、①国際的な私法上の法律関係の規律（狭義の国際私法）、②国際的な要素を含む紛争解決手続の規律（国際民事手続法）、③国際的な要素を含む取引の規律（国際取引法）を学ぶことで、上記のような事案を的確に分析できるようになることを目的とする。
This course aims at understanding the fundamental principles of (i) Japanese rules on conflict of laws, (ii) Japanese rules on international civil procedure, (iii) international trade law rules relevant to Japan. The students are expected to learn the practical operation of these rules and to improve the skills on how to properly apply them to cases with international elements.
民法の全領域を対象に、判例をベースにした事例問題あるいはオリジナルの事例問題（2023年度の演習からはテーマを変更する）に対する解答を作成し、質疑に応答することを通じて、要件・効果に関する基本的知識とともに解釈論を自ら展開する能力を身につけることを目的とする。
また、毎年新潟大学のゼミとの討論会を実施しており、今年度は12月の土日に新潟大学ゼミを仙台に迎える予定となっている。詳細は、初回授業において説明する。
The purpose of this seminar is to give students the basic knowledge of civil law and to develop the students' abilities to interpret the law through case studies.
A discussion session with seminars from other universities is planed to hold. Details will be explained in the first class.

ofJurisprudence A. It therefore keeps dealing with selected topics from the cases that are categorized as"public law litigation" in Japan. The purpose of discussion in it is to identify the problems intrinsic inthe dispute resolution through the judicial instance.
