    COURSE OBJECTIVES AND OUTLINE:

     We will discuss current topics in family law and policy in Japan and abroad. We will explore, among other things the various legal issues surrounding LGBT families, the legal and policy controversy surrounding assisted reproductive technologies, and the law and policies concerning family violence. This seminar aims to cultivate a deeper understanding and a more global perspective on issues in family law and policy.

    本来、性/セクシュアリティ(身体的性、性的指向、性自認、性表現など)や、生殖(子どもを持つか持たないか、持つならどのような方法でいつ持ち、どのような育児をするか)は、他人に脅かされず自らが自由に選択できるはずである。しかし、性や生殖の自己決定は性役割などの社会通念の影響を受けやすく、課題を抱える人が多い。

     本授業では、多様な性(セクシュアリティ)の在り方がある中で、さまざまなセクシュアリティの人が元気で幸せに生き、生殖(妊娠・出産、育児)に関する自己のプランを実現するために必要な方法(アイディア)を提案することを目指す。この体験から、自身の持つ性と生殖に関するアンコンシャス・バイアスに気づくとともに、人がより良く生きるための解決策づくりの考え方や面白さを学ぶ。

    Essentially, one should be able to freely choose aspects of their sexuality (physical sex, sexual orientation, gender identity, and expression, etc.) and reproductive decisions (whether or not to have children, how and when to have them, and how to child-raising) without being threatened by others. However, personal decisions regarding sexuality and reproduction often are affected by social norms, such as gender roles, leading to numerous challenges.

     This class aims to propose methods (ideas) for individuals with diverse sexualities to live happily and realize their plans for reproduction (pregnancy, childbirth, and childcare). Through this experience, students will become aware of unconscious biases related to their own sexuality and reproduction, and learn ways of thinking and what is interesting about materializing solutions that lead to a better life.

    In this PBL course, groups of Japanese and international students will be provided with opportunities to conduct research and give proposals on promotion of DEI (diversity, equity and inclusion) on university campus. Students will deepen their understanding of minorities in Japanese society and Tohoku University's policy of promoting DEI, and conduct their own research projects to identify problems through interviews, surveys and literature reviews, and propose how we can promote DEI campuses. This class incorporates intercultural co-learning methods where students from different backgrounds will collaborate on the projects.

    この授業は、留学生と日本人学生のグループが大学キャンパスのDEIを進めるための調査・提案を行うPBL型授業である。日本社会におけるマイノリティや東北大学のDEI推進方針に関する理解を深め、インタビューやサーベイ、文献レビューなどの調査プロジェクトを通じて課題を発見し、どのようにDEIなキャンパス作りを推進していけるのかを検討・提案する。本授業は、留学生と国内の学生が共に学ぶ国際共修授業で英語を主要言語とする。

    Today many people realize that knowing and understanding data can make difference. Even the field of law, where textual and qualitative analyses have long been the tradition, is no exception. In order to understand the social impact of a specific legal rule, it would be better to rely on actual data.

    The focus of this year is causal inference. In this seminar, we focus on how to implement causal inference employing statistical programming software. The main software is 'R'. R is an open software and you can download it for free.

    何十年もの間、日本は同質国家だと思われた。1960年代から70年代にかけて、人々は「日本の奇跡」(大規模な階級格差のない急速な経済成長)について語った。「同質社会」はその要因の一つだとされた。誰もが同じ言葉を話し、同じ文化を共有することで、調和的な社会と効率的な経済が可能になったと思われた。しかし、1990年代に入ると経済は低迷し、同質性の捉え方は「事実」から「伝説」や「幻想」に変わった(Weiner 1997)。MaherとYashiro(1995)、Denoonら(1997)、Lie(2001)などの学者は、アイヌや琉球人などの先住民族マイノリティの役割が、韓国人や中国人などの民族とともに過小評価されていると主張した。しかし、彼らの批判は表面的なものであった。Burgess(2007)が指摘するように、彼らは同質国家という神話を、多民族国家という別の神話に置き換えたにすぎない。両陣営に共通する誤りは、一般に「大和民族」あるいは口語で「純ジャパ」と呼ばれる人々の中の同質性と異質性に目を向けていないことである。それがこのコースの目的である。民族的には日本人であるが、文化的には多様なマイノリティ・グループを研究することである。

    COURSE OBJECTIVES AND OUTLINE:

    This course will serve as (1) an introduction to Japanese law to those who are new to the subject, (2) a chance to analyze and discuss a wide range of issues in Japanese law, and (3) a chance to gain a more global perspective for those who have already taken courses in Japanese law. After learning/reviewing some basic concepts, we will be discussing a range of specific topics in different areas of Japanese law. Please note that this year there will be much more family law content (and fewer other topics) than previous years (see Preliminary Class Schedule below on details of topics that will be explored in this seminar). Where appropriate, comparative perspectives from other countries will be introduced. The aim of this seminar is to (1) acquire/review the basic concepts of (Japanese) law, (2) deepen the participants’ understanding of Japanese law and Japanese society, and (3) provide a global perspective on social issues in Japan and on the approach of Japanese law in tackling these issues.
