授業の目的と概要

COURSE OBJECTIVES AND OUTLINE:
We will discuss themes in gender, law and policy, such as gender stereotypes and biases in law and legal practice, the portrayal of women in the courts and justice systems of Japan and a number of common law jurisdictions, such as Canada, Australia and the US. We will also look at the law concerning transgender persons, following two recent Supreme Court of Japan judgments relating to transgender persons. We will start the semester with more general topics about law and gender, but will concentrate on domestic violence during the latter part of the semester. This seminar aims to cultivate a deeper understanding of gender and the law, as well as to introduce a comparative perspective through readings concerning gender and law in different countries/jurisdictions.

授業内容・方法と進度予定

CONTENTS, METHOD AND PROGRESS SCHEDULE:
As this is a seminar, class time will largely be taken up by discussion. Participants are required to come fully prepared for each class. Preparation for class will consist of reading the assigned material and answering, in writing pre-assigned questions based on the reading material. These questions will form the basis for class (group) discussion. Students are also expected to prepare for and give a presentation in class.

学習の到達目標

GOAL OF STUDY:
The students will deepen their understanding of gender, law and policy, especially domestic violence and the legal challenges facing transgender persons, as well as acquire new perspectives from Japan and abroad. At the completion of this course, students will be able to discuss and analyze shortcomings and potential of law and policy on these topics from a variety of viewpoints and angles.

成績評価方法

GRADING CRITERIA:
Class participation and assignments: 80%
Presentation: 20%

There is no assigned textbook, but students are encouraged to buy H. Kennedy’s book and/or L. Goodmark’s book (see below), which should be available for purchase at the university coop (Kawauchi Minami campus).

WORK TO BE DONE OUTSIDE OF CLASS:
Students are required to prepare thoroughly for each class by reading the assigned materials and answering the assigned questions in writing. As students are also required to give a presentation in class, they will need to do research and prepare for the presentation outside of class time.

This seminar will be taught entirely in English.
All students wishing to register for this seminar should note that attendance in all of the sessions is mandatory, and absences without a good reason and without notifying the lecturer in advance will result in failing the course.
Trigger warning: We will be talking about domestic violence and sexual assault during this course.
