法は歴史的な社会の文化的所産であり、それぞれの社会に対応するものである。そこで、本講義では、各時代の法の特色とそれをもたらした政治的・社会的条件にも留意しながら、古代より戦国期までのわが国における法の歴史について通史的に論じる予定である。

This course teaches Japanese Legal History I and covers the characteristics of the laws of each period. Also remarking the political and social conditions that led to them, the history of law in Japan from ancient times to the Warring States period will be discussed throughout the history.

明治維新以降の日本における近代法の形成は、前近代日本の法文化を背景にしつつ、異質の歴史的伝統を有する西洋法を継受しながら進められた。そこで本講義においては、近代における法の特色を一通り確認し、その変遷について理解することを目的としたい。グーグルクラスルームにて行う予定です。

This course teaches Legal History of Modern Japan and covers the characteristics of Modern Japanese Law. This course’s goal is to understand of a period of transition of Modern Japanese Law.

「近世史料研究(1)」の続講。近世史料の正確な読解や基礎的な知識を身につけ、その上で自ら論点を探り、深めていく。受講者には、講義への主体的な参加を求める。なお、必ず「近世史料研究(1)」と連続で受講すること。

This course aims to improve the students' ability to read early modern Japanese document. Sutudens are required to prepare for the assigned part of the designated handouts for each class.　References(handouts) are provided.

本講義では、近世史料の正確な読解能力を養成する。素材には、伊達騒動に関する記録である「桃遠境論集」を用いる。御家騒動の代表例として名高い伊達騒動に関する史料を読み進めながら、事件そのものはもちろんであるが、近世前期の武家社会、藩主と重臣の関係、藩内政治の実像、武家文書の特徴、仙台藩士の存在形態、村と境界の問題などを考えていく。原文書のコピーを使用するため、相当の古文書読解能力を必要とする。

 近年のハプスブルク君主国史研究においては、後継諸国の国民史的視点に基づくバイアスから自由な、むしろ国民史的視点には批判的な立場からの修正史の試みが盛んに行われており、ナショナリズに対する社会・文化史的アプローチがとられることが多いが、その反面、（とりわけ英語文献では）政治史研究はやや手薄になっている。本演習では、前期に引き続き、君主国末期の代表的な政治家（外交官）で、君主国末期に共通外相（1906 – 1912）を務めた人物についての伝記研究の下記の続編を取り上げて、二重君主国の複雑な統治機構のメカニズムについての理解を深めることを目的とする。

 Solomon Wank, In the Twilight of Empire: Count Alois Lexa von Aehrenthal (1854 – 1912), Volume 2: From Foreign Minister in Waiting to de facto Chancellor (Wien – Köln – Weimar: Böhlau Verlag, 2020).

 This seminar deals with the political history of the late Habsburg Empire through a biographic study of a diplomat/politician who served as the foreign minister of the Empire from 1906 to 1912.
