Patent System and Patent Searches
特許制度と社会実装との関係について理解した上で、新規の研究開発に向けた情報分析、強くて広い特許権の取得、特許権の被疑侵害者への対応、特許権侵害の回避といったさまざまな場面で要求される特許情報の取得・活用の能力獲得を目的とする。
本授業では、まず、特許制度の仕組みや主要なルールについて理解し、特許調査がどのような場面でなぜ必要となるのかを学ぶ。その後、特許検索の具体的な手法を学び、演習問題を解きながら、実践的な特許調査の技術および基礎的な知財戦略の立案能力を獲得する。なお、本授業では、企業経営と特許情報とのかかわり等の近時のトピックスにも触れる予定である。
In this class, students will first learn about the relationship between the patent system and the realization of inventions into products and services. Obtaining and utilizing patent information is required in various situations, such as analyzing information for new research and development, obtaining strong and broad patent rights, warning suspected infringers of patent rights, and avoiding infringement of patent rights. The purpose of this class is to help students understand the structure of the patent system and acquire the ability to obtain and utilize patent information.
In this class, students will first understand the structure of the patent system and its major rules, and learn when and why patent searches are necessary. After that, students will learn specific methods of patent search and acquire practical patent search skills and basic IP strategy planning skills by working on exercises. This class will also cover recent topics such as the relationship between corporate management and patent information.
・特許制度の仕組みについて理解し、発明の社会実装や新たな研究開発と、特許権の取得・活用とがどのように関係しているのかを理解する。
・研究開発への着手、発明の権利化、侵害対応、侵害回避等のさまざまな場面で要求される特許調査（特許検索による特許情報の取得及び分析）の実践的な技能を習得する。
・To understand the framework of the patent system and to understand how the acquisition and utilization of patent rights are related to the commercialization and servicing of inventions in the marketplace and to new research and development.
・ To acquire practical skills in patent search, i.e., acquisition and analysis of patent information, which are required in various situations such as starting research and development, obtaining patent rights to inventions, warning against infringement, and avoiding infringement.

なお、知的財産制度全体について、基礎を学びたい者向けに、本授業の教員が担当している科目として、「知的財産法実務演習Ⅰ」（前期）、「知的財産法実務演習Ⅱ」（後期）がある。法学研究科で開講するものであるが、いずれも、学際高等研究教育院の指定科目であり、どの研究科の大学院生でも履修することができる。理系の大学院生等が受講することを考慮し、法学の基礎知識がなくとも無理なく知的財産制度を学んでもらえるカリキュラムとなっている。
For those who wish to learn the basics of the intellectual property system as a whole, there are "Intellectual Property Law Practice I" (first semester) and "Intellectual Property Law Practice II" (second semester), which are taught by the faculty members of this class. Both courses are offered by the Graduate School of Law, and both are designated by the Division for Interdisciplinary Advanced Research and Education. Therefore, graduate students of any graduate school can take these courses.
